December Grand Jury returns indictments

The December Grand Jury convened in the Pocahontas County Circuit Courtroom Tuesday and returned indictments against the following 19 individuals.

Arraignments in the following cases will be held December 19, 2023 before the Honorable Judge Jennifer P. Dent:

Wendell Johnson, 55, of Cass – one count, wanton endangerment involving a firearm, a felony; one count, obstructing an officer, a misdemeanor.

Kristie Moore, 34, of Marlinton – one count, entry of a building other than a dwelling, a felony; one count, conspiracy to commit a felony, a felony; one count, petit larceny, a misdemeanor.

Jeremy Moore, 38, of Marlinton – one count, entry of a building other than a dwelling, a felony; one count, conspiracy to commit a felony, a felony; one count, petit larceny, a misdemeanor.

Billy Brock, 59, of Dunmore – four counts, wanton endangerment involving a firearm, a felony; one count, use or presentation of a firearm during the commission of a crime, a felony; one count person prohibited from possessing a firearm, a misdemeanor.

Michael Beverage, Jr., 37, of Marlinton – one count, child neglect creating risk of serious bodily injury, a felony.

Dakota Beverage, 26, of Marlinton – one count, cruelty to animals, a felony; wanton endangerment involving a firearm, a felony; one count, shooting across road, a misdemeanor; one count, shooting within 500 feet of a dwelling house, a misdemeanor; one count, use or presentation of a firearm during the commission of a felony, a felony.

Clifton Summerfield, 41, of Hillsboro – one count failure to register as a sex offender, a felony.

Ashley Good, 27, of Hillsboro – one count, petit larceny, a misdemeanor; one count, entry of a building other than a dwelling, a felony.

Shawn Barb, 34, of Marlinton – one count, entry of a building other than a dwelling, a felony; one count, petit larceny, a misdemeanor.

Arnold Schoolcraft, 40, of White Sulphur Springs – one count, burglary, a felony.

Tony Allen Garretson, 52, of Marlinton– two counts, driving in a controlled substance (Methamphetamine) impaired state proximately causing death of any person, a felony; two counts, negligent homicide, a felony; one count, petit larceny, a misdemeanor.

Arraignment for Tony Allen Garretson is set for December 20, 2023. Special Prosecutor John Ours.

Arraignments in the following cases will be held December 20, 2023 before the honorable Judge Robert E. Richardson:

Christopher Gibson, 46, of Hillsboro – one count, failure to register as a sex offender or provide notice of registration changes, second or subsequent offense, a felony.

Ayden Carroll, 20, of Cass – four counts, sexual assault in the third degree, a felony; two counts, sexual abuse, third degree, a misdemeanor.

Maybelle Warner, unknown age, unknown hometown – two counts, sexual abuse in the third degree, a misdemeanor.

Zane Hickson, 69, of Cass – one count intimidation of and against public officers and employees, a felony; one count, use or presentation of a firearm during the commission of a felony, a felony; one count, obstructing an officer, a misdemeanor.

Thomas Schoolcraft, 39, of Buckeye – one count, strangulation, a felony; one count, domestic battery, a misdemeanor; one count, trespassing, a misdemeanor.

Michele Stewart, 46, of Hillsboro – one count, grand larceny, a felony; one count, driving while license revoked, a misdemeanor.

Justin Arbogast, 35, of Valley Head – one count, attempted entry of a dwelling or outbuilding, a felony; one count, conspiracy to commit a felony, a felony.

Ashley Welch, 31, of Valley Head – one count, attempted entry of a dwelling or outbuilding, a felony; one count, conspiracy to commit a felony, a felony.

An indictment is not proof of guilt. A person is considered innocent until proven otherwise by a jury of their peers.
