According to Pocahontas County Circuit Clerk Connie Carr, the following hearings were held April 24 before the Honorable Judge Robert E. Richardson:
A status conference was held in the case the State vs Gary D. Cool, 35, of Monterville, wherein defense counsel requested a second forensic psychological evaluation for her client as he felt the first evaluation report was not consistent. The court, out of an abundance of caution, ordered the defendant to undergo another revaluation. Cool was remanded to custody.
The court adjudged Danielle L. Smith, 30, of Marlinton, guilty of delivery of a Schedule II controlled non-narcotic substance and fraudulent use of an access device. The matter was referred to the probation department for a presentence investigation report. Sentencing and disposition is set for June 26. Smith was remanded to custody.
Trial is set for July 24 in the case the State vs Charles Calhoun, 33, of Marlinton. Calhoun was released from custody and reinstated on his previous bond.
