According to Pocahontas County Circuit Clerk Connie Carr, the following hearings were held June 6 before the Honorable Judge Jennifer P. Dent:

In a status conference in the case the State vs Kenneth R. Peck, Jr., 41, of Arbovale, the court granted defense counsel’s motion for an expert to check the tape of the defendant’s confession statements taken at the time of his arrest to be sure it is complete, and granted a motion for a continuance of the status conference. Peck waived his right to a speedy trial. Trial is set for October 10.

Darin Ramsey, 29, of Durbin was sanctioned to Tygart Valley Jail for three weekends for violating the terms of his probation. Ramsey failed to contact his probation officer. The court noted that this is the third time the defendant has been revoked on probation for failure to report.

A bond revocation hearing was held in the case the State vs Roslynn Nichole McCarty, 19, of Marlinton, wherein the court revoked the defendant’s current bond and reinstated bond at $40,000 – 10 percent cash and 90 percent personal recognizance – with the added conditions of Day Report and drug treatment program.

A hearing was held to modify terms and conditions of probation in the case the State vs John Martin Stull, 28, of Bartow. Defense counsel asked that her client be allowed to travel out of state for drug treatment. The court continued the hearing until records are received from Pennsylvania and reviewed. Information will be released to the probation officer. Stull will be allowed to travel to Pennsylvania June 12 for treatment.

Several hearings were held June 11 before the Honorable Judge Robert E. Richardson, wherein defendants waived their rights to a speedy trial.

Plea negotiations are ongoing for Shawn M. Waugh 30, of Elkins.

Amanda Bennett, 32, of Marlinton, asked that her trial be set in this term.

A psychological evaluation was ordered for David Wayne Sharp, 55, of Marlinton.
