The following hearings and arraignments were recently held in Pocahontas County Circuit Court before the Honorable Judge Patrick I. Via:

Paul Charles Clement, 42, of Marlinton, failed to appear for his arraignment and the State asked that an arrest warrant be issued. Clement was indicted on one count, failure to register as a sexually violent predator or provide notice of registration changes.

The State asked for a continuance in its case against Mulvie W. Grimes II, 57, of Scottsdale, Arizona, until the summons to appear can be served to him in Arizona. Grimes was indicted on one count embezzlement of fiduciary.

Jamie Witek, 42, of Beverly, pleaded not guilty to one count, fraudulent schemes. He waived his right to a speedy trial and remains on present $7,000 bond.

Cory B. Alderman, 40, of Marlinton, pleaded not guilty to two counts, domestic battery, third offense; and one count, domestic assault, third offense. He waived his right to a speedy trial. Bond was set at $5,000 PR. Alderman may only leave the state for employment, and he is to have no direct or indirect, physical or verbal contact with the victims.

Steven H. Sharp, 39, of Marlinton, pleaded not guilty to one count, possession with intent to deliver methamphetamine, a Schedule II controlled non-narcotic substance; and one count, possession with intent to deliver marijuana, a Schedule I, controlled non-narcotic substance. He waived his right to a speedy trial and remains on present $15,000 bond. Sharp will be drug screened through Day Report.

Arnold Schoolcraft, 41, of White Sulphur Springs, pleaded not guilty to one count, counterfeiting; and one count, unlawful assault on law enforcement officer. He was remanded and transported to the Tygart Valley Regional Jail.

Jason F. Brickles, 47, of Valley Head, pleaded not guilty to one count, murder in the first degree; one count, use or presentment of a firearm during commission of a felony; four counts, wanton endangerment with a firearm; one count, person prohibited from possessing a firearm; and two counts, destruction of property. The defense tendered a motion for a speedy trial during this term of court. Pre-trial conference is set for May 29. Bond has been set at $600,000, with special condition that Brickles is to have no direct or indirect, physical or verbal contact with those affected by this matter.

A plea agreement has been reached in the case the State vs Roy Myers, 50, of Durbin. The State will make corrections to the agreement. A change of plea is set for May 14. Myers was indicted by the April 2022 Grand Jury on one count, child neglect resulting in serious bodily injury; and one count, child neglect creating a substantial risk of death.

The Special Prosecutor asked for a trial date to be set in the case the State vs Mason Slava Walker. Walker waived his right to a speedy trial during this term of court. A five-day jury trial is set for September 8. Pre-trial conference is set for August 28. Walker was indicted on one count, murder in the first degree; one count, use or presentment of a firearm during the commission of a felony; and one count, person prohibited from possessing a firearm.

Jeremiah B. Powell, 43, of Buckeye, pleaded guilty to one count unlawful assault. The matter is set for sentencing and disposition May 15. Powell was remanded to custody pending sentencing.

Daniel C. Good, 34, of Durbin, has successfully completed the drug court program. The court granted the withdrawal of the defendant’s plea, and the State asked that the case be dismissed.
