OF VALUABLE REAL ESTATE
Notice is hereby given that the undersigned, MICHAEL C. DOSS, Trustee, by virtue of that certain Deed of Trust executed by Gary M. Sharp and Carmen K. Notice of Request for Determination of Valid Existing Rights
Invitation for Interested Persons to Participate

The Office of Surface Mining Reclamation and Enforcement (OSMRE) received a request on September 18, 2024, for a determination that South Fork Coal Company (SFCC) has Valid Existing Rights (VER) to use an existing United States Forest Service (USFS) road as a coal mine access and haul road across Federal lands within the Monongahela National Forest in Pocahontas County, West Virginia. By this notice, OSMRE is inviting interested persons to participate in the proceeding and to submit relevant factual materials on the matter.
SFCC alleges that it possesses VER to use a 1.2 mile portion of road located within the Monongahela National Forest, known as USFS Road 249, either through a special use permit issued by USFS (Permit No. FS-7700-41), or in the alternative, through mineral rights it has acquired. The subject portion of USFS Road 249 is located approximately 7 miles west of Hillsboro, West Virginia, northwest of Briery Knob, and east of the South Fork of Cherry River. USFS Road 249 begins at an intersection with Pocahontas County Route 29/4, also known as Briary Knob Road, and runs 1.2 miles west and south towards the border of Greenbrier County.
OSMRE invites interested persons to provide additional factual information as to whether SFCC has the valid existing right to use USFS Road 249 as described. OSMRE will also publish notice of this request in the Federal Register on or about March 20, 2025, with additional information.
