Embezzlement charge against former prosecutor dismissed

Senior Status Judge Thomas H. Keadle has granted a dismissal of the embezzlement charge against former Pocahontas County Prosecutor Donna Meadows Price.

Special assistant prosecutor Kristin Cook informed the court July 28 that the matter had been resolved in that Price agreed to reimburse the Pocahontas County Commission “all the restitution amounts assessed in the matter,” and the state made a Motion to Dismiss with prejudice.

The Order of Dismissal reads in part, “The Court inquired of the parties whether or not resolving the matter would be in the best interest to all parties involved, including the people of Pocahontas County. Counsel for the State informed the Court that due to the nature and circumstances surrounding the case, the relatively low reimbursement amount, the costs of proceeding with prosecution and judicial economy and fairness, the State believed that dismissing the case with prejudice with the condition of reimbursement was in the State’s best interest. No objections were made by the Defendant or her counsel to the State’s Motion to Dismiss.”

Defense Counsel Tim Carrico asked to speak on the record, stating that the defendant was not admitting guilt by agreeing and tendering a reimbursement check to the county.

According to the state, the restitution amount was assessed at $1,059.47.

A check for that amount was issued to the county commission on July 31.

The case was dismissed and removed from the court docket.
