According to Pocahontas County Circuit Clerk Connie Carr, the following hearings were held May 15 before the Honorable Judge Jennifer P. Dent:

An arraignment hearing was held in the case the State vs Tyler A. Bowman, 19, of Lewisburg, wherein the defendant pleaded not guilty to two counts, sexual abuse in the first degree; one count, sexual assault in the second degree; and one count, sexual assault in the third degree. He remains on $10,000 surety bond.

The court deferred sentencing of Roslyn McCarty, 20, of Marlinton, pending a diagnostic evaluation.

Carl Lee Kidd, 37, of Arbovale, was sentenced to two years’ probation on the charge of grand larceny, with the added condition of substance abuse assessment and evaluation.

Michael A. Stewart, 34, of Buckeye, was sentenced to two years’ probation with normal terms and conditions, and added conditions of substance abuse assessment and evaluation, Day Report, BIPS and parenting classes. The defendant may be employed out of state as long as he complies with the terms of his probation.

Shanda May Stull, 27, of Bartow, has complied with the terms of her pre-trial diversion, and the court dismissed her charges.

Kimberly K. Waid, 44, of Marlinton waived her right to an evidentiary hearing and asked to be returned to the Commonwealth of Virginia to face charges. If officials from Bath County, Virginia, fail to pick up the defendant in 10 days, a status hearing will be held May 30.

Defense counsel did not accept the State’s offer in the case the State vs Gary W. McKenney, 68, of Marlinton. The court denied a defense motion to dismiss the matter. Pre-trial is set for May 30.

George Matthew Harmon, 27, of Marlinton, was found competent to stand trial and to assist his legal counsel. Status hearing is set for July 17.

Ferrell Kelly, 55, of Marlinton, was found competent to stand trial and to assist his legal counsel. The matter is remanded to Magistrate Court for further proceedings.
