The following hearings were recently held in Pocahontas County Circuit Court before the Honorable Judges Robert E. Richardson and Patrick I. Via

An in-person plea hearing was held in the case the State vs Jeffrey Thomas Rose, 29, of Hillsboro, wherein defense counsel advised the court that the defendant will not be changing his plea and wishes to go to trial. Jury trial is set for October 21. Rose was indicted on one count, strangulation; one count, kidnapping; two counts, domestic battery; three counts, domestic assault; one count, interfering with emergency communications.

Bond for Austin Keith Fultz, 31, of Cass, was modified to $15,000 surety with the added condition of home confinement, drug screening and GPS monitoring upon release from incarceration. Fultz was indicted on one count, possession with intent to deliver methamphetamine, a Schedule II, controlled non-narcotic substance; one count, possession with intent to deliver marijuana, a Schedule I, controlled non-narcotic substan- ce; one count possession with intent to deliver Xanax, a Schedule IV, controlled non-narcotic substance; one count, possession with intent to deliver Gabapentin, a Schedule V, controlled non-narcotic substance.

A hearing on petition to revoke probation was held in the case the State vs Casey Crabtree, 30, of Marlinton, wherein the court found the defendant was in violation of the terms of her probation. The court ordered a first-time sanction of 60 days in the Tygart Valley Regional Jail. Crabtree is to resume the conditions of probation after the 60 days.

Earl Ray Adkins, 56, of Renick, was sentenced to not less than one year nor more than five years to the West Virginia Department of Corrections. Sentences to run concurrent with the sentence the defendant is now serving. Adkins was given 154 days’ credit for time served. Court costs were assessed and Adkins was remanded to custody.

In an August 6 status hearing, Cassey Marie Beverage, 34, of Marlinton, contested the allegations in a petition and challenged the results. A motion for home confinement was denied. In an August 18 hearing, Beverage agreed to the allegations, the court reinstated PR bond with home confinement with all the previous terms and conditions. The court also ordered substance abuse assessment and day report.

A remote hearing to set trial date was held in the case the State vs Travis Rider, 39, of Marlinton, wherein the State asked to continue the hearing because a witness (police officer) was on medical leave. The court denied the motion and set bond at $5,000 cash or surety or personal recognizance with GPS monitoring. Trial is set for August 24-25.

In arraignment hearings:

Burt William Harmon, 44, of Marlinton, did not appear for his arraignment hearing as he is incarcerated in Virginia. Hearing is continued.

Austin Keith Fultz, 31, of Cass, pleaded not guilty to all charges in the indictment and asked for a speedy trial. The court denied a motion for bond modification. Two-day trial is set for October 28-29.

Burt William Harmon, Jr., 29, of Marlinton, pleaded not guilty to one count, burglary; one count, destruction of property; and one count, receiving or transferring stolen goods. Two-day trial is set for October 28-29. The court set a blanket bond of $50,000 for this and another case against Harmon.

Regis H. Markl, 49, of Valley Head, pleaded not guilty to one count, burglary; one count, grand larceny; and one count, unlawful taking of a vehicle. Bond was set at $5,000, cash or surety, with the condition of home confinement if Randoph County agrees to supervise.

Christina Mae Geise, 44, of Arbovale, pleaded not guilty to two counts, fraudulent use of an access device; and 10 counts, fraudulent possession of an access device. The court did not set bond because of pending sentencing in another case. Two-day trial is set for October 15-16.
