The following cases were recently heard in Pocahontas County Circuit Court before the Honorable Judge Patrick I. Via:
Based upon a review of the evidence and circumstances, the State moved to dismiss without prejudice its case against Harley Lennon Squires, of Hillsboro, and any bond posted is to be returned.
Armando Capo, 51, of Brooklyn, New York, did not appear for his rescheduled arraignment hearing. Defense counsel advised the court that they had spoken with Mr. Capo, but did not know his whereabouts. The matter is continued until the defendant is apprehended. Capo was indicted on one count, fleeing from a law enforcement officer with reckless indifference of the safety of other persons; and one count, child neglect causing risk or serious bodily injury.
A status hearing was held in the case the State vs Brandon A. Waddell, 38, of Durbin, wherein defense counsel asked for a continuance as they had just been appointed to the case and have not discussed it with the defendant. Waddell waived his right to a speedy trial in this term of court. He was indicted on one count, domestic battery, second offense.
Randall Moore, 45, of Arbovale, appeared by video from the Tygart Valley Regional Jail for a status hearing. Counsel of record is developing a special questionnaire for the trial. A four-day jury trial is set to begin May 20. Moore was indicted on one count, murder in the first degree.
Jesse Glen Feury, 34, of Marlinton, appeared for his arraignment at which time he pleaded not guilty to one count, conspiracy; one count, entry of a building other than a dwelling; and one count, grand larceny.
Jeremiah Bleu Powell, 43, of Buckeye, appeared by video from TVRG for a status hearing wherein it was revealed that the parties are negotiating a plea offer. Powell was indicted on one count, burglary; and one count, trespassing.
A hearing on petition to revoke probation was held in the case the State vs Angela Turner, 50, of Marlinton, wherein the court found that the defendant had violated the terms and conditions of her bond, specifically alcohol. The court extended Turner’s probation for 90 days and sanctioned her to home confinement for 90 days with the added condition of counseling concerning alcohol and any recom- mendations by the probation department.
Roy Lambert, Jr., 56, of Bartow, tendered a written plea agreement to the court wherein he pleaded guilty to the lesser count of sexual offense in the third degree, a misdemeanor. The matter was referred to the probation department for a pre-sentence investigation report. A hearing will be set on acceptance of plea/disposition. Lambert remains on current bond.
A change of plea hearing is set for April 17 in the case the State vs Hunter Gabriel Grimes, 31, of Marlinton. Grimes was charged with burglary and entry of a dwelling or outbuilding.
A change of plea hearing was held in the case the State vs Kristie Dawn Moore, 35, of Marlinton, wherein the defendant pleaded guilty to Count II of the indictment, the felony offense of conspiracy to commit a felony. Th court accepted the plea and placed Moore on one year of supervised probation. The court granted the State’s motion to dismiss Counts I and III of the indictment with prejudice.
