The following hearings were recently held in Pocahontas County Circuit Court before the Honorable Judges Robert E. Richardson and Jennifer P. Dent:
The court found probable cause and revoked bond for Taylor Cook, 37, of Marlinton. Cook was indicted by the April Grand Jury on one count, assault; one count, destruction of property; three counts, malicious assault. According to Magistrate Court records, Cook was arrested on similar charges June 5.
Michelle Stewart, 47, of Hillsboro, tendered a written plea agreement to the court wherein she pleaded guilty to the felony offense of grand larceny. The court accepted the plea and deferred the matter for one year on probation.
A corrected plea agreement was tendered to the court by Skylar Tincher, 25, of Buckeye, wherein he pleaded guilty to the felony offense of wanton endangerment involving the use of a firearm. The matter was referred to the probation department for a presentence investigation. Tincher was remanded to custody to await the sentencing hearing, scheduled for July 24.
Gregory Ryan Keatley, 41, of Marlinton, was found guilty of trespassing and was fined $100 and assessed costs of the proceeding.
Wendell Edward Johnson, 55, of Cass, tendered a written plea agreement with the court wherein he pleaded guilty, according to Kennedy v Fraiser, to the misdemeanor offense of brandishing a deadly weapon, the lesser offense in his indictment. The matter is referred to the probation department for a presentence investigation. Sentencing is set for August 1.
A status hearing was held in the case the State vs Joseph Lynn Thompson, 32, of Marlinton, wherein the state requested that Thompson remain incarcerated and has filed a motion to revoke his bond. A hearing on the motion is scheduled for June 13. Thompson was indicted by the April Grand Jury on one count, malicious assault.
A status hearing was held in the case the State vs Michael Beverage, Jr, 37, of Marlinton, wherein defense counsel advised the court that the defendant was in a rehab program and asked for a continuance to allow him to complete the program and consider any negotiations with the State. Beverage was indicted on one count, child neglect creating risk of serious bodily injury, a felony.
Roger W. Teter, Jr. 50, of Dunmore, tendered a written plea agreement to the court in April, at a June 6 hearing, the court adjudged him guilty of the misdemeanor offense of petit larceny. Teter was placed on probation for one year. No restitution; court costs were assessed as judgment.
David Mace, 38, of Marlinton, appeared by video from the Tygart Valley Regional Jail for his plea hearing. Mace entered no contest pleas of guilty to two counts of strangulation. The court accepted the pleas and adjudged him guilty. The matter is referred to the probation department for a presentence investigation. Sentencing and disposition is set for August 8.
