According to Pocahontas County Circuit Court Clerk Connie Carr, the following arraignments and hearings were held January 3 and 4 before the Honorable Judge Jennifer P. Dent:
Dustin D. Morrison, 22, of Marlinton, pleaded not guilty to one count possession with intent to deliver a Schedule II controlled non-narcotic substance. No bond was set and the defendant was remanded to custody.
Jerry Thomas Rose, 21, of Hillsboro, pleaded not guilty to one count entry of a building other than a dwelling and one count petit larceny. Defendant remains on $5,000 bond.
Eden Denys Taylor, 32, of Lizemores, pleaded not guilty to one count imposition of sexual acts on person incarcerated or under supervision. He remains on bond and is to have no contact with the victim.
Danielle L. Smith, 28, of Marlinton, appearing by video from the Tygart Valley Regional Jail, pleaded not guilty to five counts of fraudulent use of an access device.
A change of plea hearing was held in the case the State vs Stuart Tingler, 31, of Millboro, Virginia, wherein the defendant tendered a written plea agreement to the court and was placed on diversion for two years. The court will hold Tingler’s plea of guilty to domestic battery third offense with conditions of home confinement and day report. If he successfully completes the terms of the diversion agreement, he will change his plea to guilty of domestic battery second offense, a misdemeanor, and will be placed on probation. If he is not successful in completing the terms set forth, he will be incarcerated according to his original plea of guilty to a felony.
A hearing on a defense motion for parole was held in the case the State vs James Richard Cassell, 50, of Arbovale, wherein defense counsel advised the court that Cassell has been on home confinement for one year and has continued in his employment. The state has received no negative information concerning the defendant, and the court placed him on parole for one year.
A change of plea hearing was held in the case the State vs Rodney W. Brewer, 44, of Dunmore, wherein the defendant pleaded guilty to one count possession with intent to deliver a Schedule IV controlled non-narcotic substance. Sentencing and disposition is set for February 28. The court granted the state’s motion to dismiss with prejudice Case 16-M-19 as well as a charge in 16-B-30.
Drema Renee Tinney, 49, of Marlinton, pleaded not guilty to one count of forgery. She remains on $10,000 bond.
