Notice is hereby given that the following foreign will or affidavit of heirs has been filed in the Pocahontas County Clerk’s Office at 900 Tenth Avenue Suite C; P. O. Box 209, Marlinton, WV 24954-0209.
An interested person(s) objecting to the filing of the foreign will or affidavit or objecting to the absence of appointment or administration being made in this state must file a statement with the Pocahontas County Commission through the County Clerk’s Office at the address listed above within 60 days after the date of first publication or 30 days of service of the notice, whichever is later. If an objection is not timely filed, the objection is forever barred. The Pocahontas County Commission, upon receiving any timely objection thereto, shall schedule a hearing or hearings thereon and order relief, if any, it considers proper including, but not limited to, an order directing that full and complete ancillary administration of the estate of the nonresident decedent be made in this state.

TOWN OF DURBIN GARBAGE ORDINANCE
Chapter 5: Town of Durbin Garbage Ordinance
Section 5-1 Amending and Revising the Town of Durbin Garbage Ordinance
A. For the purpose of absorbing, with amendments, the former ordinance known as Chapter 4, Town of Durbin Garbage Ordinance, and dated March 14, 2017.
B. To adjust the required minimum fee for garbage collection and disposal in the Town of Durbin.
Section 5-2 Garbage Collection and Disposal Fee
A. It is therefore Ordered and Ordained by the Council of the Town of Durbin that there shall be a garbage fee of $10.00 per month for all residential customers. A change from $10.00 per month for all garbage collection will now be structured as follows:
Residential – $10 per month with a 20-bag limit per month
Unoccupied dwelling – $10 per month
Small Businesses – $15 per month with a 50-bag limit per month.
Large Businesses – $20 per month with a 100-bag limit per month.
Section 5-3 Restrictions defined
Bag limit will be five (5) bags per week or twenty (20) bags per month per residential customer, Twelve (12) bags per week or (50) bags per month for small businesses, and Twenty-five (25) bags per week or One Hundred (100) bags per month for large businesses. Any customer over the allotment stated above will be charged $1.00 per bag. *Small businesses consist of small apartment complexes, Airbnbs, retail shops, art studios, etc. *Large businesses consist of restaurants, campground, rail station, etc.
Customers wishing to use their own dumpsters and garbage removal company can be used at the owner’s own expense. They will still be responsible for paying the Town of Durbin the specified rate stated in section 5-2 of this ordinance.
Two (2) large kitchen bags will constitute one (1) thirty (30) gallon bag for purposes of convenience of the customers.
A. Bags shall be limited to fifty (50) pounds in weight and no larger than thirty (30) gallons in size.
B. All garbage shall be positioned in an area convenient for pickup on owner’s property.
C. Proper weather and animal proof receptacles should be used by a customer wishing to do so and said receptacles should be maintained and kept clean.
D. All building materials, lawn or tree trimmings, TV’s, Appliances, apples, and boxes are prohibited.
E. All biohazardous materials are prohibited from being placed in customer’s garbage. These biohazardous materials include medical needles, or sharp objects that could cause harm to the town employee.
Section 5-4 Billing
Each individual invoice sent has a due date for remittance of payment. If paid after this date a ten percent (10%) late fee will be assessed.
Section 5-5 West Virginia Code
Pursuant to West Virginia Code 8-13-13, subsection (d), the Town of Durbin, after 60 days of non-payment, will serve notice to the account holder, by certified mail, return receipt requested, that the Town of Durbin will file a lien, if permissible, unless the delinquency amount is paid by the date stated on the notice, which will be not less than ninety (90) days from the date the notice is mailed. The administrative procedure must include the right to appeal to the circuit court of the county in which the real property is located. The circuit court shall consider the appeal under its general authority, including but not limited to subsection (f), section two (2), article two (2) of chapter fifty-one (51) of this code.
