According to Pocahontas County Circuit Clerk Connie Carr, the following cases were heard February 8 before the Honorable Judge Jennifer P. Dent:
Plea negotiations are ongoing in the case the State vs Kevin Phillips, 44, of Marlinton. Phillips is charged with two counts, delivery of a Schedule III controlled narcotic substance.
The State withdrew its motion to revoke bond in the case the State vs Rodney W. Brewer, 44, of Durbin. Defense counsel advised that the defendant has another case in which the bond was set at $25,000 by Magistrate Court. The bond in this particular matter is $1,000. The court granted the State’s motion for a blanket bond in the amount of $30,000 with the condition of home confinement. Brewer is charged with delivery of a Schedule I substance.
The court denied a defense motion for reconsideration, to allow probation, in the case the State vs Darin Ramsey, 28, of Durbin. In an evidentiary hearing in December, Ramsey admitted violating one or more terms of his probation.
An evidentiary hearing was held in the case the State vs Kristopher Dale Nutter, 37, of Marlinton, wherein the court sanctioned the defendant for 80 days. In the meantime, if an appropriate facility for drug rehab is found, counsel may request a reconsideration. Nutter will be placed on probation after the sanction with the condition of home incarceration.
