According to Pocahontas County Circuit Clerk Connie Carr, the following hearings were held November 27 before the Honorable Judge Robert E. Richardson:
A status hearing was held in the case the State vs Charles R. Calhoun, 34, of Marlinton, wherein defense counsel advised that several motions are outstanding and a resolution cannot be reached. The court set a motions hearing for December 20. Jury trial is set for January 16, 2020.
Sentencing and disposition were held in the case the State vs Gary D. Cool, 35, of Monterville, wherein the state asked that due to the defendant’s lengthy criminal history, he be given the maximum sentence. Defense counsel asked that his sentence run concurrent with his sentences in other counties. Cool was sentenced to one year in the regional jail to run consecutive to any other sentences is is now serving. He was fined $250 plus costs.
Trial is set for December 16 in the case the State vs Jonathan C. Shearer, 31, of Marlinton. The clerk was instructed to pull 35 jurors no later than December 13. If the matter is resolved by a plea agreement, a change of plea hearing could be set for December 2.
