According to Pocahontas County Circuit Clerk Connie Carr, the following hearings were held June 26 before the Honorable Judge Robert E. Richardson:
A sentencing and disposition hearing was held in the case the State vs Jerry Wayne Curry, 58, of Marlinton, wherein the court sentenced Curry to not less than one year nor more than three years in the state penitentiary for driving revoked DUI, third offense; sentence to run concurrent with one he is now serving in Pendleton County. Curry was fined $3,000 and assessed costs, and will have three years from the time he is released from the Department of Corrections to pay the same. Curry was remanded to custody and given 117 days’ credit for time served.
Danielle Lee Smith, 30, of Marlinton, was sentenced to not less than one year nor more than five years in the state penitentiary for delivery of a Schedule II controlled non-narcotic sub- stance. She was also sentenced to one year in the state penitentiary for fraudulent use of an access device. Sentences are to run concurrently. Smith was given 233 days’ credit for time served. The court recommends residential substance abuse treatment. Smith was remanded to custody.
A modification of bond hearing was held in the case the State vs Dalton Wayne Cain, 19, of Marlinton, wherein the court granted a defense motion to reduce bond from $10,000 to $2,000 cash or surety. Cain was remanded to custody.
Buck Ryan Barker, 57, of White Sulphur Springs tendered a written plea agreement to the court wherein he offered a Kennedy Plea to the lesser offense of brandishing. The court accepted the plea and the matter is set for sentencing and disposition July 24. Barker remains on current bond.
