The following hearings were recently held in Pocahontas County Circuit Court before the Honorable Judges Robert E. Richardson and Jennifer P. Dent:
An agreement has been reached between the State and Roy Myers, 49, of Durbin. A change of plea hearing is set for September 5. The matter will remain on the trial docket until a plea is taken. Myers was indicted by the April 2022 Grand Jury on one count, child neglect resulting in serious bodily injury; and one count, child neglect creating a substantial risk of death.
An agreement has been reached between the State and Clifton Summerfield, 41, of Hillsboro. A change of plea hearing is set for September 12. Summerfield was indicted on one count failure to register as a sex offender.
Jennifer Peck, 44, of Durbin waived her right to indictment by a grand jury and pleaded guilty to one felony count of possession with intent to deliver methamphetamine, a Schedule II controlled non-narcotic substance. In turn, she will enter the Southeastern Drug Court Program. The court accepted the plea but deferred adjudication as the defendant enters drug court.
In-person sentencing was held in the case the State vs David W. Mace, 38, of Marlinton, wherein defense counsel asked for alternative sentencing of home confinement or probation. The State objected and asked for the maximum sentences to run consecutively. The court sentenced Mace to the state penitentiary for not less than one year nor more than five years for one felony count of strangulation. The court sentenced him to not less than one year nor more than five years in the state penitentiary for a second felony count of strangulation. The sentences will run consecutively. Mace was given 693 days’ credit for time served. He will be referred to the RSAT program within the WVDOCR. Mace was remanded to custody.
