The following hearings were recently held in Pocahontas County Circuit Court before the Honorable Judges Robert E. Richardson and Jennifer P. Dent:
Charles Irvine, 49, of Marlinton, appearing by video from the Tygart Valley Regional Jail, waived his right to a preliminary hearing on a motion to revoke his alternative sentencing. Irvine admitted to the allegations in the petition, and the court found probable cause that the defendant had violated the terms and conditions of his alternative sentence. An evidentiary hearing is set for May 1.
An in-person arraignment was held in the case the State vs Brent Prouse, 34, of Huntington, wherein bond was set at $20,000, personal recognizance, with the special condition that the defendant completes the Lighthouse program in Huntington. Prouse, who was indicted on One Count, attempted possession of a controlled substance by an inmate, a felony; One Count, offense committed by an inmate, a felony; One Count, conspiracy to commit a felony, a felony, pleaded not guilty to all counts.
Bond for Kristina Shingleton, 52, of St. Albans, was set at $20,000, 90% PR and 10% cash/surety. Shingleton, who was indicted on One count, attempted delivery of a controlled substance to a correctional facility, a felony; One Count, transportation of a controlled substance onto the grounds of a correctional facility, a felony; One Count, conspiracy to commit a felony, pleaded not guilty to all counts.
Jessica Dawn Snelson, 41, of Durbin, pleaded not guilty to One Count, grand larceny, a felony. Bond was set at $7,000 cash/surety with the special condition of no contact, physical or verbal, direct or indirect, with the victim.
Clifton Summerfield Jr., 40, of Hillsboro pleaded not guilty to One Count, person prohibited from possessing a firearm, a felony. He remains on a previously set PR bond of $5,000.
Kevin Ray Curry, 34, an inmate in the Mt. Olive Correctional Center, pleaded not guilty to One Count, escape from custody of the Commissioner of Corrections, a felony; One Count, offense by an inmate, a felony; One Count, grand larceny, a felony. Bond was set at $20,000, a blanket bond for all charges.
A capias was issued for William Steven Feury, 29, of Marlinton, who failed to appear for his status hearing. It was noted that the defendant did not appear for the last hearing. Feury was indicted on One Count, entry of a building other than a dwelling, a felony; One Count, attempted grand larceny, a felony.
Angela Turner, 48, of Marlinton, asked that her trial be held in this term of court. The matter is set for Jury Trial July 19. Turner was indicted on one count, driving while license revoked for driving under the influence of alcohol, third offense, a felony.
A status hearing was held in the case the State vs Erick Shawn Romanello, 23, of Marlinton, wherein the state advised that the matter is ready for a change of plea. Romanello was indicted on One Count, driving while license revoked for driving under the influence of alcohol, third offense, a felony; One Count, possession of a Schedule III controlled narcotic substance, Buprenorphine, a misdemeanor.
The case the State vs Spencer Combs, 20, of Marlinton, is ready for a change of plea. The matter is set for May 16. Combs was indicted on One Count, sexual assault third degree, a felony.
David W. Mace, 37, of Marlinton, appeared by video from the TVRJ for a status hearing, wherein defense counsel advised the court that the parties are nearing an agreement. Mace was indicted on Three Counts, strangulation, a felony; Two Counts, wanton endangerment involving a firearm, a felony.
A status hearing was held in the case the State vs Joshua Ray VanReenen, 35, of Hillsboro, wherein defense counsel advised the court that they had not been able to contact the defendant. The state related that not all discovery had been provided and asked for the matter to be continued. VanReenen was indicted on One Count, malicious assault, a felony; One Count, wanton endangerment involving a firearm, a felony; One Count, use or presentation of a firearm during the commission of a felony, a felony.
Austin Carden, 23, of Dunmore pleaded not guilty to One Count, grand larceny, a felony; One Count, destruction of property, a felony; One Count, conspiracy, a felony. Bond was set at $7,500 and the defendant is to have no contact with the victim or the victim’s properties.
Christopher M. Gibson, 46, of Buckeye, pleaded not guilty to One Count, failure to register as a sex offender or provide notice of registration changes, second or subsequent offense, a felony. Bond was set at $10,000 PR.
Justin Arbogast pleaded not guilty to One Count, sexual assault in the first degree, a felony; One Count, sexual abuse by a parent of a child, a felony; One Count, incest, a felony. Bond was set at $25,000, 90% PR and 10% cash/property/surety, with the condition of home confinement in Randolph County with GPS monitoring and no contact of any kind with the victim.
Landon Matthew Gibson, 20, of Buckeye, pleaded not guilty to One Count, petit larceny, a misdemeanor; One Count, grand larceny, a felony; One Count, burglary, a felony. He remains on previously posted bond, which shall be a blanket bond for Count I of the indictment.
Phyllis J. McCray, 44, of Belington, pleaded not guilty to One count, grand larceny, a felony; One Count, destruction of property, a felony; One count, conspiracy, a felony. She remains on previously posted $10,000 bond, which shall be a blanket bond for Count II of the indictment.
Steven Kelley Bennett, 48, of Green Bank, pleaded not guilty to One Count, grand larceny, a felony; One Count, destruction of property, a felony; One Count, conspiracy, a felony. He remains on a previously posted $10,000 PR bond, which shall be a blanket bond for Count II of the indictment.
An evidentiary hearing was held in the case the State vs Shawn Barb, wherein the defendant waived his right to the hearing. The court found that Barb had violated his bond, and it was revoked. Barb was indicted on One Count grand larceny, a felony; Two Counts, receiving or transferring stolen property, a felony; One Count, obtaining property by false pretenses; One Count, receiving or transferring stolen property, a misdemeanor; One Count, petit larceny, a misdemeanor; One Count, destruction of property, a misdemeanor.
