The following hearing was held September 19 in Pocahontas County Circuit Court before the Honorable Jennifer P. Dent:
John M. Stull, 34, of Bartow, appeared for his in-person plea/sentencing hearing wherein he pleaded guilty to Count I of the indictment, person prohibited from possessing a firearm, a misdemeanor; and Count II, negligent shooting, a misdemeanor. Stull was adjudged guilty of the same, and requested to serve any time on weekends, which was denied.
Due to the seriousness of the charges, the defendant was sentenced to one year in the regional jail as to Count I and one year in the regional jail as to Count II. Sentences were to run consecutively. Sentences were then suspended, and Stull will serve 30 days in the regional jail in three periods of 10 days as designated: 9/22/2024 to 10/1/2024; 10/20/2024 to 10/30/2024; and 11/10/2024 to 11/20/2024.
Stull is to self-report at 8 a.m. to the Tygart Valley Regional Jail for each of the three designated periods and shall self-report to the Pocahontas County Home Incarceration Program after release from each designated period. In the interim, he will be hooked up on home confinement, if approved. No fines. Court costs were assessed.
