The following hearings were recently held in Pocahontas County Circuit Court before the Honorable Robert E. Richardson and Jennifer P. Dent:
A status hearing was held in the case the State vs Tony Garretson, 53, of Marlinton, wherein the trial set for September will be continued. Both judges in the 11th Circuit have contested abuse/ neglect matters set which take precedence over a trial. There are also medical issues with both parties in this case. The matter is set for November 18. Garretson was indicted on two counts, driving in a controlled substance (Methamphetamine) impaired state proximately causing death of any person; two counts, negligent homicide; one count, petit larceny.
A plea agreement has been reached, but not reduced to writing, in the case the State vs Justin R. Arbogast, 36, of Valley Head. The trial, which was set for August 22, has been continued.
