According to Pocahontas County Circuit Clerk Connie Carr, the following hearings were held August 28 before the Honorable Judge Robert E. Richardson:
A hearing to revoke alternative sentencing was held in the case the State vs Lynn David Jordan, Jr., wherein the defendant waived his right to a hearing and admitted to allegations in the motion. The court sanctioned Jordan due to violations. He was sentenced to the regional jail for 10 days, with nine days’ credit for time served. He will serve the remainder of his sentence on home incarceration. Jordan was remanded to custody.
An extradition hearing was held in the case the State vs Shelia Smith, wherein Smith waived her right to an extradition hearing. Authorities from the State of Virginia will have 10 days to take Smith into custody.
An evidentiary hearing was held August 29 in the case the State vs Phillip Andrew Hamilton, wherein the defendant waived his right to an extradition hearing. Authorities from Bath County, Virginia, will have 10 days to take Hamilton into custody.
The following hearings were held before the Honorable Judge Jennifer P. Dent:
A sentencing and disposition hearing was held in the case the State vs Eden Denys Taylor, 34, of Indore, wherein the defendant appeared by conference call. Defense counsel stated that her client did not have transportation to the hearing. The court has allowed Taylor to appear by phone for rulings during this hearing, but the state relates that a pre-sentence investigation report has not been done due to the defendant’s lack of appearance before the probation department. The court granted the state’s request for a capias to be issued. Taylor is to be held at the Tygart Valley Regional Jail and the matter is set for the court to go over sex offender conditions with the defendant before sentencing.
The court determined that Gary W. McKenney, 69, of Durbin, is competent to assist his counsel and to proceed to trial. McKenney remains on previous bond with home confinement and other conditions. He will be living at the East Fork Campground in Durbin.
The court extended the probation period for Kiana Woodhouse, 21, of Marlinton, to allow time for her to pay court costs.
An arraignment hearing was held in the case the State vs Joseph Tawney, 37, of Marlinton, wherein the defendant pleaded not guilty to burglary, entry of a building other than a dwelling, grand larceny, and two counts, transferring stolen goods. Tawney remains on current bond.
A capias was issued for Jeffery Thomas Rose, 22, of Hillsboro, who failed to appear for his disposition hearing.
A capias was issued for Brandon Waddell, 33, of Durbin, who failed to appear for his change of plea hearing.
The court granted a continuance of a hearing on a petition for revocation of pre-trial diversion in the case the State vs John Martin Stull, 29, of Bartow.
A non-jury trial is set for October 30 in the case the State vs Terri Dawn Bradshaw, 39, of Hillsboro. The court is allowing time for both parties to consider negotiations. This matter concerns a lack of dash cam video related to a traffic stop.
