The following hearings were recently held in Pocahontas County Circuit Court before the Honorable Judges Robert E. Richardson and Patrick I. Via:
Isaiah Bennett, 20, of Buckeye, appeared by video from the Tygart Valley Regional Jail for a hearing on motion to reinstate bond. Bennett asked for reinstatement with the condition of home confinement at his grandmother’s residence. The State objected to the specific residence. Bennett’s bond was reinstated with the special terms and condition that upon release he shall immediately participate in a treatment program and will be transported to the same. If he completes the program, he may then return to his grandmother’s residence subject to all terms and conditions of his bond, except “no contact” condition.
A pre-trial hearing was held in the case the State vs Travis Rider, 34, of Marlinton, wherein the court directed the clerk to pull 40 jurors for the trial. Rider was indicted on one count, attempt to commit a felony; one count, trespassing; and one count, harassment.
A hearing to revoke bond was held in the case the State vs Jesse Glen Feury, 35, of Marlinton, wherein a capias was ordered as the defendant was not present. Following the hearing, Feury called to say he was five minutes away from the courthouse and the hearing resumed. The capias was withdrawn. Feury admitted to the allegations in the petition to revoke bond and he was sentenced to the original determinate sentence of four months in the regional jail with 11 days credit for time served. He was remanded to custody.
Jason Powell, 20, of Hillsboro, did not appear for his scheduled competency evaluation. The State asked that the defendant be incarcerated to proceed with the evaluation. The matter is set for September 24. Powell was indicted on one count, strangulation.
Charles Robert Calhoun, 40, of Marlinton, appeared by video from the TVRJ. He is under federal custody, and the state relates he is considering a plea. Calhoun indicated that he signed a federal plea the day before this hearing. The Court, for good cause, continued this matter into the next term of court.
The Court found that Christina Mae Giese, 44, of Arbovale, violated the terms and conditions of drug court and terminated her from the program. The probation department is to prepare a pre-sentence investigation report. Adjudication is set for September 3.
Robert A. Jordan, 24, of Marlinton, waived his right to an extradition hearing, and is willing to return to Highland County, Virginia. Authorities from Virginia are to pick up the defendant within 10 days. The Court denied bond for the 10-day period.
